Terms & Conditions

These Terms & Conditions ("Terms") govern the engagement between Cybrinix and the Client for the provision of digital, automation, AI, and related services. By engaging our services, you acknowledge that you have read, understood, and agreed to these Terms.

  1. Project commencement and payment. A 50% advance payment is required before any work begins. The remaining balance must be paid in full before final delivery, deployment, or handover of the project.
  2. Non-refundable payments. All payments, including advance payments and milestone payments, are strictly non-refundable unless otherwise agreed in writing by Cybrinix.
  3. Scope of work. Any additional features, modifications, changes, or enhancements requested outside the agreed scope shall be billed separately and may result in revised timelines.
  4. Delivery and ownership. Final source code, automation workflows, designs, and related intellectual property rights shall be transferred only upon full payment clearance.
  5. Excluded costs. Costs related to domains, hosting, cloud infrastructure, third-party APIs, telephony services, and external platforms, including services provided by OpenAI, Meta, Twilio, or similar providers, are excluded unless expressly included in the scope of work and shall be borne by the Client.
  6. Support and maintenance. Unless otherwise agreed in writing, bug-fix support shall be provided for a period of one (1) year from the date of delivery. New feature development, upgrades, and ongoing maintenance are not included in this support period.
  7. Third-party platforms. Cybrinix shall not be liable for any downtime, service interruptions, delays, or failures caused by third-party platforms, service providers, integrations, or external infrastructure.
  8. Client responsibilities. The Client shall provide all required content, credentials, approvals, feedback, and information in a timely manner. Delays exceeding 14 business days may result in suspension of work and additional charges.
  9. Performance expectations. Cybrinix does not guarantee any specific sales, leads, conversions, rankings, or return on investment from marketing, automation, or related services.
  10. Late payments and dispute resolution. Any delayed payments shall attract interest in accordance with the applicable provisions of the MSMED Act, 2006. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bhopal, Madhya Pradesh.
  11. Compliance and legal responsibility. The Client shall remain solely responsible for ensuring compliance with all applicable data privacy, telemarketing, and regulatory requirements relating to the use of the delivered solution.

These Terms form the basis of our engagement and may be updated from time to time. Any changes shall be communicated to the Client in writing.
